1. The Guarantee — What We Promise

JC Websites guarantees that your website will be fully built, tested, and published live on your domain within seven (7) calendar days of the Onboarding Completion Date (defined in Section 2 below).

If we fail to deliver a live, functional website within this 7-day period for reasons within our control, you are entitled to a full refund of all amounts paid to JC Websites in connection with your project — including your deposit.

This guarantee reflects our confidence in our process and our commitment to every client. We do not offer it lightly, and we stand behind it completely.

2. How the 7 Days Are Counted

2.1 The Onboarding Completion Date

The 7-day delivery clock starts on the Onboarding Completion Date — the date on which you have submitted all required project materials in full, as specified in your onboarding form. These materials include, but are not limited to:

  • All written content for each page of the website (headings, body text, calls to action, etc.)
  • Your logo in a suitable file format (PNG with transparent background, SVG, or AI/EPS)
  • All images and photography to be used on the site
  • Brand guidelines or colour/font preferences (if any)
  • Domain registrar login credentials or access (if you already own a domain)
  • Any other materials listed in your project onboarding form

Partial submissions do not trigger the guarantee clock. We will confirm the Onboarding Completion Date in writing (via email) on the day we receive a complete submission.

2.2 Calendar Days, Not Business Days

The 7-day window runs on calendar days, not business days. This means weekends and public holidays in Western Australia are included in the count. Day 1 begins at 11:59 PM AWST on the Onboarding Completion Date.

3. What "Delivered" Means

For the purposes of this guarantee, a website is considered "delivered" when all of the following conditions are met on or before Day 7:

  • The website is live and publicly accessible at your confirmed domain URL
  • All pages agreed in the project scope are present and functional
  • The website loads correctly on major modern browsers (Chrome, Firefox, Safari, Edge)
  • The website is mobile-responsive on standard smartphone screen sizes
  • The contact form (if included) is functional and submits correctly
  • All content provided by you has been incorporated as agreed
  • Basic on-page SEO has been applied (page titles, meta descriptions, image alt text)

Minor cosmetic imperfections, font rendering differences between devices, or browser-specific quirks that do not affect usability do not constitute non-delivery under this guarantee.

4. Conditions for the Guarantee to Apply

To be eligible for a refund under this guarantee, all of the following conditions must be satisfied:

  • You have paid the 50% deposit to initiate the project
  • You have submitted all required content and materials in full on the Onboarding Completion Date, as confirmed by us in writing
  • You have responded to our review link and provided feedback within 24 hours of it being sent (delays in your review response that cause us to miss the deadline are excluded — see Section 5)
  • Your refund claim is submitted in writing within 7 calendar days of the guaranteed delivery date passing
  • You have not materially altered the project scope after the Onboarding Completion Date without a signed written variation
  • The delay was caused by JC Websites and not by circumstances outlined in Section 5

5. Exclusions — When the Guarantee Does Not Apply

The 7-day delivery guarantee is suspended or void in the following circumstances:

5.1 Client-Caused Delays

  • You failed to submit complete content and materials by an agreed deadline
  • You did not respond to our review link within 24 hours of it being sent
  • You requested changes to the agreed scope after the Onboarding Completion Date, which required additional design or development time
  • You provided incorrect, incomplete, or conflicting instructions that required rework
  • You were unresponsive to communications from us for more than 12 hours during the active build phase

5.2 Domain-Related Delays

  • Delays caused by domain registrar processing times, DNS propagation (which can take up to 48 hours and is outside our control), or third-party domain transfer complications
  • You failed to provide domain credentials or registrar access when required
  • Your existing domain had complications (e.g., active locks, pending transfers, unpaid renewal fees) that prevented us from updating DNS records
Note on DNS Propagation: After a domain is pointed to a new server, it can take up to 48 hours for the change to propagate globally. Where DNS propagation delays would cause us to miss the 7-day deadline, we will notify you in advance and provide proof of our actions. In this specific circumstance, the guarantee deadline extends by the propagation period (maximum 48 hours).

5.3 Force Majeure

Events beyond our reasonable control that prevent or delay delivery, including but not limited to: natural disasters, widespread internet outages, government-imposed restrictions, power failures, cyberattacks on our infrastructure, or illness of key personnel, are excluded from the guarantee. We will notify you as soon as practicable if such an event occurs.

5.4 Scope Disputes

If a dispute arises about what was agreed in the project scope, and that dispute delays delivery, the guarantee is suspended until the scope is clarified in writing. We will make every reasonable effort to resolve scope disputes promptly.

5.5 Approved Extensions

If both parties agree in writing to extend the delivery deadline (e.g., because you have requested additional features), the extended deadline replaces the original 7-day deadline for the purposes of this guarantee.

6. How to Make a Refund Claim

If you believe we have not delivered your website within the guaranteed 7-day period and you wish to claim a refund, follow these steps:

Email jcwebsiteagency@gmail.com with the subject line: "7-Day Guarantee Claim — [Your Name]". Include your project name, Onboarding Completion Date, and a brief explanation of the delay.

Claim Window

Your claim must be submitted within 7 calendar days of the guaranteed delivery date passing. Claims submitted after this window will not be considered.

We Review Your Claim

We will acknowledge your claim within 1 business day and review the project timeline, communications, and circumstances within 3 business days.

Decision & Outcome

We will provide a written decision. If your claim is approved, your refund will be processed within 5–10 business days. If your claim is not approved, we will explain the specific reasons.

7. Refund Amount & Processing

7.1 Full Refund

If a valid claim is approved, you will receive a full refund of all amounts paid to JC Websites for the project — including the 50% deposit ($325 AUD) and any further amounts paid. The refund will be issued to the same payment method used for the original transaction.

7.2 Processing Time

Approved refunds will be processed within 5–10 Australian business days of the claim approval. The time for funds to appear in your account after processing depends on your bank or payment provider and is outside our control.

7.3 Partial Completion

In the unlikely scenario where we have partially delivered the website (e.g., the website is live but missing agreed elements), we may offer a partial refund or a credit proportionate to the incomplete work, in lieu of a full refund, at our discretion. We will always discuss this outcome with you before finalising.

7.4 No Other Compensation

The refund described in this guarantee is the sole and exclusive remedy for late delivery. JC Websites is not liable for any indirect, consequential, or incidental losses arising from a delay in delivery, including loss of business, revenue, or opportunities.

8. After a Refund Is Issued

If a full refund is issued under this guarantee:

  • The project agreement between you and JC Websites is terminated
  • All work product created for your project (designs, code, staging sites) remains the intellectual property of JC Websites and will not be provided to you
  • Any domain registered by us on your behalf during the project will be transferred to you at no additional cost, even if a refund has been issued
  • You are free to engage another provider to complete your website project

9. Relationship to Our Terms & Conditions

This 7-Day Delivery Guarantee forms part of and should be read alongside our Terms & Conditions. In the event of any inconsistency between this document and the Terms & Conditions specifically regarding delivery timelines and refund entitlements, the terms of this Guarantee document will take precedence.

All other provisions of the Terms & Conditions (including payment terms, intellectual property, limitation of liability, and dispute resolution) remain in full force and apply to all projects, including those subject to this guarantee.

10. Australian Consumer Law

Our services come with guarantees that cannot be excluded under the Australian Consumer Law. This 7-Day Delivery Guarantee is offered in addition to, and does not limit or exclude, any rights you have under the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)), including your rights to:

  • Services provided with due care and skill
  • Services that are fit for the purpose you made known to us
  • Services that are delivered within a reasonable time (where no time is fixed)

If you believe your consumer rights under Australian law have been breached independently of this guarantee, you may also contact the Australian Competition and Consumer Commission (ACCC) at www.accc.gov.au or Consumer Protection WA at www.commerce.wa.gov.au/consumer-protection.
