By engaging JC Websites ("we", "us", "our") for any services — whether through our website, email, phone, or any other means — you ("the Client", "you") agree to be bound by these Terms & Conditions in their entirety.
If you do not agree to these Terms, you must not proceed with engaging our services. These Terms constitute a legally binding agreement between you and JC Websites, ABN [insert ABN], operating from Perth, Western Australia.
These Terms should be read in conjunction with our Privacy Policy and 7-Day Delivery Guarantee, both of which are incorporated by reference.
JC Websites provides professional website design and development services to small and medium-sized businesses, primarily in Perth, Western Australia. Our standard service package includes:
Additional services (e.g., e-commerce functionality, custom integrations, copywriting, photography, ongoing SEO management) are not included in the standard package and will be quoted separately. Any agreed additional services will be documented in a written proposal or variation to your project agreement.
We reserve the right to decline any project at our discretion, including but not limited to projects that involve unlawful, offensive, misleading, or harmful content.
All projects follow our 9-step process: Enquiry → Proposal → Contract & Deposit → Onboarding → Design → Development → Client Review → Launch → Post-Launch Support.
We guarantee that your website will be live and published within seven (7) calendar days of the Onboarding Completion Date — defined as the date on which you have submitted all required content materials in full. The full terms and conditions of this guarantee are set out in our separate 7-Day Delivery Guarantee document.
The 7-day delivery clock begins only once we have received all of the following from you:
Incomplete submissions will be returned for completion and will not start the delivery clock.
After development, we will provide a staging link for your review. You have two (2) business days to submit consolidated revision requests. Revisions are limited to changes to the agreed scope. Requests for new features, additional pages, or scope changes during review may incur additional charges and extend the timeline.
If you cause delays through late content submission, late feedback, or unresponsiveness (no reply within 3 business days during the active project phase), the 7-day guarantee and agreed delivery date are suspended until normal communication resumes. We are not liable for any delays caused by you or third parties outside our control.
The standard project fee is $650 AUD (inclusive of GST where applicable). This fee covers everything listed in Section 2. The fee is confirmed in writing in your project proposal and must be agreed to before work commences.
A non-refundable deposit of 50% ($325 AUD) is required before project work begins. Payment of the deposit constitutes your acceptance of these Terms & Conditions and the written project proposal. Work will not commence until the deposit is received and cleared.
The remaining 50% balance ($325 AUD) is due upon your approval of the completed website, prior to the live launch. We will not transfer domain ownership or publish the website to the live domain until full payment has been received and cleared.
We accept payment via bank transfer (BSB/account number provided on invoice), PayID, or other methods as agreed in writing. All amounts are in Australian Dollars (AUD).
If the final payment is not received within seven (7) calendar days of the invoice being issued at the review stage, we reserve the right to suspend the project. If payment is not received within 30 days, we reserve the right to terminate the project and retain the deposit. Interest on overdue amounts may be charged at 2% per month.
If JC Websites is registered for GST, applicable GST will be included in all invoices. Clients will receive a valid tax invoice for all payments.
To ensure a successful and timely project, you agree to:
You warrant that all information, content, and materials provided to JC Websites are accurate, lawful, and do not infringe any third-party rights, including intellectual property, privacy, or defamation laws.
Upon receipt of full and final payment, all intellectual property rights in the completed website — including the design, code, and content created by us — are assigned to you. You will own the website outright.
Until full payment is received, JC Websites retains all intellectual property rights in all work product, including designs, code, mockups, and staging sites. You may not use, copy, reproduce, or publish any such work until full payment is made.
You retain all intellectual property rights in the content, images, logos, and materials you provide to us. By providing such materials, you grant JC Websites a non-exclusive, royalty-free licence to use them solely for the purpose of delivering your project.
You grant JC Websites a perpetual, non-exclusive right to display your completed website as part of our portfolio, on our website, and in marketing materials, unless you notify us in writing otherwise within 14 days of launch.
Where open-source or licensed third-party components (e.g., fonts, icons, libraries) are used in your website, those components remain subject to their respective licences. We will ensure all third-party components used are appropriately licensed for commercial use.
Following the live launch of your website, JC Websites will provide thirty (30) calendar days of complimentary post-launch support, which includes:

After the 30-day support period, ongoing support and maintenance services are available at our standard hourly rate, quoted on request.
Where domain registration is included in your package, JC Websites will register one domain name (.com.au or .com) on your behalf. The domain is registered in your name and/or business name. You are the legal owner of the domain from the date of registration.
Domain registration is included for the first registration period (typically one year). Renewal fees after that period are your responsibility. We will advise you of your domain's expiry date and renewal obligations at the time of launch. JC Websites is not responsible for domain expiry or loss resulting from your failure to renew.
Hosting setup is included as part of the project. However, ongoing hosting costs (after any free trial period provided by the hosting provider) are the client's responsibility. We will advise you of hosting arrangements and any associated ongoing costs at the time of project setup.
Upon launch and full payment, we will provide you with all access credentials for your domain registrar, hosting account, and website management tools. You are responsible for maintaining the security of these credentials.

Nothing in these Terms limits or excludes any guarantee, warranty, right, or remedy that cannot be excluded under the Australian Consumer Law or any other applicable legislation.
To the maximum extent permitted by law, JC Websites' total liability to you for any loss, damage, or claim arising out of or in connection with these Terms or any services provided shall be limited to the total amount paid by you for the relevant project.
JC Websites will not be liable for:
These limitations apply whether the claim is based in contract, tort (including negligence), statute, or any other basis, and even if JC Websites has been advised of the possibility of such damages.
You may terminate the project at any time by providing written notice to JC Websites. If you terminate after the deposit has been paid but before project completion, the deposit is non-refundable. If work beyond the deposit stage has commenced, you may be invoiced for work completed to date at our standard hourly rate.
We reserve the right to terminate a project if:
In the event of termination by us (other than for your breach), we will refund any amounts paid that exceed the value of work completed to date.
Upon termination, all licences granted under these Terms cease immediately. You must immediately pay all outstanding amounts. Work product will not be released until all outstanding amounts are settled.
In the event of a dispute arising from these Terms or any services provided, the parties agree to attempt to resolve the dispute in good faith through direct negotiation before pursuing any formal legal proceedings.
If the dispute cannot be resolved through direct negotiation within 14 calendar days of one party giving written notice of the dispute to the other, either party may refer the matter to mediation through a mutually agreed mediator, or to the relevant tribunal or court in Western Australia.
Nothing in this clause prevents either party from seeking urgent injunctive or declaratory relief from a court where necessary to protect their rights.
These Terms & Conditions are governed by and construed in accordance with the laws of Western Australia, Australia. Both parties submit to the exclusive jurisdiction of the courts of Western Australia for the resolution of any disputes arising under or in connection with these Terms.
These Terms also operate in compliance with the Australian Consumer Law (Schedule 2 to the Competition and Consumer Act 2010 (Cth)) and the Privacy Act 1988 (Cth).
JC Websites reserves the right to update or modify these Terms & Conditions at any time. Updated Terms will be published on our website with an updated effective date. Changes will not affect projects already under a signed agreement at the time of the change.
Your continued engagement of our services after updated Terms are published constitutes your acceptance of the revised Terms.
